Facts:	The police stopped the defendant after a store owner called stating that the defendant was cursing at him and was causing a disturbance. When the officer stopped him, the defendant had jumped out the car and the officer immediately handcuffed him. Officers then noticed an odor of alcohol, mushed mouth/slurred speech, and watery eyes. He performed poorly on the field sobriety tests, which consisted of the HGN (eye test), walk and turn, and one leg stand. The defendant was arrested for DUI and later refused a breath test.
Defense:	The firm filed a motion to suppress alleging that the traffic stop was unlawful. We provided case law to the State, that simply cursing at the store owner was not enough to stop the defendant. Also, there was no disorderly conduct because no one else was around. Also, we filed a motion to suppress alleging that the defendant was unlawfully arrested (a defacto arrest) when he was initially handcuffed. Prior to trial date, the State Dropped the DUI.

Facts:	The defendant was stopped for speeding. Officers observed an odor of alcohol, glossy/watery eyes, and she made incoherent statements. Facts:	The defendant was stopped for driving without headlights and running a stop sign. Officers noticed an odor of alcohol, bloodshot eyes, and she had difficulty speaking. The defendant admitted to having drank vodka. She performed poorly on the field sobriety exercises, which consisted of the HGN (eye test), one leg stand, and walk and turn. She was arrested for DUI and later blew a .092 and .090 in the breath machine.
Defense:	After conversations with the State regarding the .02 margin of error in the breath machine, we were able to place the defendant's breath alcohol results under the legal limit.

Facts:	The defendant was stopped for weaving and straddling the lane markers. The Officer did not smell an odor of alcohol, but he seemed dazed and confused, his speech was slurred/mumbled, and he admitted to smoking marijuana that day.
